If last will not existed


Everyone knows that if you own a real estate or other property in Thailand, then it is necessary to make a last will. But why? what will happen if there is no last will?

In Thailand there is an inheritance under the law. In total there are 6 classes of relatives, each enters the inheritance according to the order.

✔ For example, if there are children (1st grade), parents (2nd grade) can no longer claim the inheritance. The heirs of one class share property in equal shares.

✔ The spouse will receive an equal share with each child, half - if sharing with parents or full brothers and sisters, two-thirds with relatives of other classes, or will inherit the property completely if there are no relatives of any of the 6 classes.

How can relatives inherit?

Through the court, showing evidence of kinship. The procedure will be quite simple if all relatives give up their shares in favor of one person. The court will need certified refusals and a statement by one heir wishing to enter the inheritance.

If each relative claims their part, all of them can sign a statement of inheritance and, possibly, authorize one of them to represent their interests in Thailand. If there is no consent in the family, everyone will go to court on their own and will defend their right to inheritance.
