New rental rules for residential real estate


On October 31,2019 the Contracts Committee published a notice:

The Stipulation of Residential Property Leasing as a Contract-Controlled Business.

Recall that the first notice was published on February 16, 2018. The document severely limited the rights of business operators and granted more rights to tenants who enter into agreements with business operators. The new notice establishes more flexible lease terms for business operators.

The rules apply only if the lessor is a business operator (5 or more real estate objects under management for leasing to different tenants - rooms, houses, apartments in condominiums and other objects except hostels and hotels).

Notifications establish the mandatory conditions that must be taken into lease agreement by the business operator in each lease, as well as provisions that are prohibited from being included in the contract. If there are no such conditions in the contract or the business operator in the contract indicates the conditions that will worsen the tenant’s situation or the contract will include prohibited provisions, such conditions will not have legal force.

The new notice will enter into force on January 30, 2020. From now on, the first notice will no longer apply.

A new notice will not be retroactive. Contracts concluded before January 30, 2020 must comply with the conditions of the first notice.
